Court approves transfer of Ingush native Albagachiev to prison regime

The Astrakhan Regional Court refused to cancel the decision to transfer Abdul-Malik Albagachiev, a native of Ingushetia, to prison, the “Public Verdict” Foundation* reported in its Telegram channel. An advocate has stated that the court did not take into account the health state of Abdul-Malik Albagachiev and announced the intention to file an appeal against the court’s decision.

The “Caucasian Knot” has reported that on August 7, the Sovetsky District Court of Astrakhan changed the detention regime for Abdul-Malik Albagachiev to prison. A forensic examination noted that the health state of Abdul-Malik Albagachiev is deteriorating, as he is not receiving the necessary medical treatment in the penal colony.

On July 30, Abdul-Malik Albagachiev had an epileptic attack, but a medical officer came only two hours later. Relatives claimed that Abdul-Malik Albagachiev’s frequent epileptic attacks were caused by the consequences of torture to which he had been subjected by law enforcers. The advocate emphasizes that the lack of medical care gives grounds to demand compensation for physical and moral harm.

“I consider the court’s decision illegal. The court did not take into account the health state of Abdul-Malik Albagachiev and did not accept an independent medical examination as defence arguments,” stated advocate Irina Biryukova.

The “Caucasian Knot” has also reported that on March 19, human rights defenders reported about the tortured conditions of the Abdul-Malik Albagachiev’s detention in the penal colony.

In August 2018, Abdul-Malik Albagachiev was sentenced to nine years of imprisonment. According to the investigators’ version, in the period from January to March 2015, the man fought in Syria against government forces. Abdul-Malik Albagachiev complained about torture during the investigation.
