As "Kavkazsky Uzel" wrote, a member of the Communist Party of the Russian Federation from Rostov Oblast, Lyudmila Borzilo, complained that security forces had groundlessly opened a criminal case against her, and officials were trying to place her children in an orphanage for her active civic position. According to Borzilo, his wife is prohibited from communicating with the media and using means of communication. He claims that the investigator "continues to use punitive medicine" and by his actions endangers not only the life of Lyudmila, but also their future child, whom they are expecting in early January.

At the end of May, Borzilo was put on the wanted list, and on August 15, the Proletarsky District Court, at the request of the same investigator, placed her in a psychiatric clinic, considering her "dangerous to society and to herself." Borzilo herself was not invited to the court hearing. Lyudmila Borzilo learned that she was wanted only recently from her appointed lawyer.

Borzilo's lawyer criticized the conclusion of the forensic psychological-psychiatric commission

The ruling, citing the conclusion of the forensic psychological-psychiatric expert commission No. 24 of April 7, 2025, states that Borzilo was diagnosed with a psychiatric disorder with a tendency to constant complaints, lawsuits and litigation.

One of Borzilo's lawyers, on condition of anonymity, told a "Caucasian Knot" correspondent that similar diagnoses in Soviet practice were given to dissidents, but in modern practice such a code is rare and refers to protracted, difficult to diagnose variants. The list of symptoms in the Rostov conclusion looks, according to the lawyer, like a compilation, and not like a description of actually established clinical signs.

According to the lawyer, the investigator's petition emphasizes that a woman with many children, who is married and leads an active social life, "cannot understand the essence of procedural actions and her situation." According to the defense, such wording effectively deprives her of the right to independently participate in procedural actions and limits her civil rights.

He recalled that the official conclusion of the commission dated April 7, 2025 was refuted and criticized by an independent expert - Doctor of Medical Sciences, forensic psychiatric expert with 30 years of experience Vasily Belov. According to his conclusion, prepared on May 28, 2025 at the request of the family, the commission's document "does not meet the criteria of reliability and objectivity" and contradicts the requirements of the Federal Law "On State Forensic Activity" No. 73-FZ.

The expert named the following as the main violations: the diagnosis code was incorrectly selected and indicated (it is claimed that code F20.82 in ICD-10 refers to a different disease); there is no description of the methods and valid diagnostic tools used; the conclusion is based on subjective judgments, and not on objective scientific data; the case materials do not contain information about the professional training of the experts who signed the Rostov conclusion, as well as their signatures on responsibility for knowingly false conclusions.

The expert concluded that the commission's conclusion of April 7, 2025 "does not meet the criteria of reliability and objectivity ... and cannot be used as evidence in the case of Borzilo L.A.", however, according to Borzilo's defense, all attempts to present this conclusion in the case are rejected by the judges without explanation.

Earlier, the commission of the State Budgetary Institution of the Rostov Region "Psychiatric Hospital" indicated in its conclusion that it is not possible to fully and comprehensively assess Borzilo's mental state in an outpatient setting.

“Why this commission was able to establish the disease on April 7, 2025, can only be guessed at, given the active interest of the investigation in isolating Borzilo from society, if not in a temporary detention facility due to having many children and being pregnant, then at least in a psychiatric hospital,” the lawyer emphasized.

Defense-assigned attorneyLarisa Savchenko insisted at the court hearing on August 15 that the investigator refuse to re-place the client in a psychiatric clinic. According to her statement, the investigator’s demands are illegal. “According to Article 203 of the Criminal Procedure Code of the Russian Federation, the forced placement of a suspect or accused in a medical facility is only possible for the purpose of conducting a forensic examination, and not for holding a person there. This placement is carried out only for the purpose of conducting a forensic examination, and not for treatment or forced hospitalization,” Savchenko explained in court. However, the court still ruled to send the pregnant woman to a mental hospital until September 17 as "dangerous to herself and others."

Borzilo's family faces pressure

Borzilo's eldest daughter Tatyana said that their family has been under pressure from local officials and security forces for a year now, which creates a "nervous atmosphere." Tatyana claims that the family has still not received answers in the case of her younger brother, who was born in 2016: according to their information, the child was declared stillborn, but there are no reliable results of examinations or explanations for the circumstances of death. "We believe that this child is alive and was stolen, because no one has proven otherwise. And for these reasons, my mother has been declared insane. Moreover, it is classified as "secret," " Tatyana Borzilo told a "Caucasian Knot" correspondent.

Tatyana also reported that a document from June 25 appeared in the case, in which she is listed as the mother's representative "in connection with her alleged inability to independently perceive reality." According to her, she has a power of attorney from her mother, and she is going to defend her mother by proxy and complain about her persecution. "Only a court can declare a person incompetent and then appoint a representative for him. "There is no such decision or such grounds for my mother," the daughter is sure.

"Such stress is completely unnecessary for all pregnant women. We lost our child in 2016 due to the fault of medical workers. And we still don't know whether he is alive or dead," Sergei Borzilo commented on the situation.

He claims that investigators refuse to give the family the results of the exhumation examination, although they promised to do so back in 2024. "Instead, the investigation is hiding the examination and has started to harass my wife, trying to put her in a mental hospital, where the child we are expecting will simply die," the man said.

According to him, Lyudmila is currently under observation in a private clinic. "She had an ultrasound, she was 18 weeks pregnant, and they told us we were having a girl," he added.

In a letter to her husband from the psychiatric clinic, Lyudmila complained about the conditions there. "Patients were beaten, insulted, not allowed to go to the toilet, mocked. I helped the elderly because the nurses mocked them. When I was indignant, they threatened to "write everything that needs to be written," she said.

The Zimovnikovsky Interdistrict Investigative Department and the Proletarsky District Court refused to comment on the situation with Lyudmila Borzilo to a "Caucasian Knot" correspondent, citing the "secrecy of the investigation" and the "closed nature of the trial."

At the same time, the defense emphasizes that the "gravity" of the criminal case itself, which provides only for a fine and up to four months in prison, is not worth the enormous resources that the investigation spends on "solving the crime."

And he is busy only with trying to treat a mother of many children with a falsified diagnosis in a closed institution with a ban on talking about his actions. All authorities from the administration to the court are involved in the absurd case of "disclosing the secret of adoption". At the same time, the "victim" himself never hid the fact that he was an adopted son of Lyudmila's relatives and the "disclosure" occurred when he was an adult. Lyudmila herself has already apologized many times and admitted her mistake, explaining it by an emotional breakdown, since for several years she could not get the investigation to conduct an examination of the body of her allegedly deceased child, which should have been done immediately after she gave birth to him,” the lawyer added.
