Ecologist Vitishko denied clemency

The defence of Evgeny Vitishko intends to appeal against the decision of the Kirsanov District Court of the Tambov region, which rejected the motion asking to change his remaining term in colony for restriction of freedom. The defence intends to appeal against this decision at a higher court.

In June 2012, Evgeny Vitishko was sentenced to three years of conditional imprisonment on charges of damaging the fence around the territory, known as the "dacha" (summer residence) of Alexander Tkachov, the then Governor of the Krasnodar Territory. In December 2013, the court changed his conditional term for a real one to be served in the Tambov Region.

The "Caucasian Knot" has reported that on April 15 this year the Kirsanov District Court refused to release Vitishko under conditional early relief (CER). On June 25, the Tambov Regional Court rejected the appeal against the denial of CER.

According to Loktev, a lawyer, under Article 80 of the Russian Criminal Code, a convict, who was sentenced for a crime of medium gravity, has the right to mitigation after serving at least one third of his or her sentence. He added that only 10 months expired since the last reprimand, imposed on Vitishko for violating the colony regime.

The conclusion draw up by the psychological service of the colony says that "Vitishko is vigorous, balanced, serious, careful, wise, focused on his own opinions, while feeling lonely and isolated."

At the trial, the representative of the prosecutor's office said that because of his un-removed punishments and absence of rewards, the above Vitishko's motion should be rejected.
