Activist Tamara Mearakishvili filed a cassation appeal against the Tskhinvali City Court's decision to deport her to a location other than Georgia.

As reported by the "Caucasian Knot," on December 22, the South Ossetian Prosecutor General's Office announced that a criminal case for espionage had been opened against a Georgian citizen. According to security officials, Mearakishvili, while in South Ossetia, collected and transmitted information about strategically important facilities. On December 31, by court order, Mearakishvili was deported from South Ossetia and returned to Georgia. Her lawyer stated that he had not been notified of her client's deportation. On January 3, Mearakishvili stated that she had not yet decided whether to appeal the court's decision, but she wanted to return to her homeland.

Tamara Mearakishvili filed a cassation appeal against the Tskhinvali City Court's decision to deport her to Georgia. "Today is the first working day after the New Year's holidays, and today I filed a complaint with the court," Mearakishvili told a "Caucasian Knot" correspondent on January 12. Mearakishvili's complaint calls the court's decision illegal and unfounded, violating the citizen's constitutional rights, both substantive and procedural. Mearakishvili noted that she is a citizen of South Ossetia and that she acquired citizenship "legally in 2013" by renouncing her Georgian citizenship. Mearakishvili said: "I had to prove that I have Georgian citizenship, acknowledge the illegality of my acquisition of citizenship, and terminate this South Ossetian citizenship, and only then apply administrative deportation. Termination of citizenship is applied and proven in court, but these demands were not considered by the court, and administrative deportation with a fine was immediately imposed. "These actions are illegal, as a person cannot be deported from the country without terminating their citizenship, and this article of the Code of Administrative Offenses of the Russian Federation was applied unlawfully against me," the document states.

Mearakishvili also recalled that she was born and permanently resided in the Leningorsky District, and, therefore, is a citizen of South Ossetia by birthright.

Mearakishvili said she filed the complaint via email. "There was no other option, as I was immediately deported before the appeal or the court's decision came into force. However, Alan Gagloev deprived me of this opportunity. "I hope that no obstacles will be created for the consideration of the complaint," she says.
